New Medical Marijuana Law May Create New Obligations For Property Owners and Managers

A new law allowing the medical use of marijuana took effect on January 1, 2013.  The new law creates a hardship exemption for qualifying patients permitting them to cultivate a 60-day supply of marijuana.  The Department of Public Health is supposed to issue regulations on or before April 30th.  Until then, it is unclear what all of the implications are for property owners and managers, such as conflict with federal law, fair housing and non-smoking policies in apartment buildings.  GBREB will continue to monitor new regulations and has provided a general advisory for members.    Click for Member Advisory
